Alien Resident Certificate (ARC) Extension

A foreign national who holds an ARC (or Resident Certificate for the Taiwan area) may apply for ARC extension if the ARC is going to be expired and the reason of residence remains. But if the reason of residence had changed, the foreigner has to re-apply for a new ARC.

For example, a foreigner submitted an ARC in the reason of studying. He or she wishes to stay in Taiwan to start a business after the graduation; then he or she needs to apply for a new ARC in the reason of employment or entrepreneur rather than extend the old one.

This article will focus on discussing ARC extension; explaining extension procedures for entrepreneurs.

Foreign nationals who hold Alien Resident Certificates (ARC)

A.

The employer should apply to Workforce Development Agency for an extension of the work permit four months before the expiry of the work permit (We suggest not less than one month). Since the company has established more than one year, its average turnover, actual import and export revenue, or commission in the most recent year or for the past three years must reached no less than three million (3,000,000) New Taiwan Dollars, five hundred thousand (500,000) United States Dollars, or two hundred thousand (200,000) United States Dollars so the company can meet the qualification of the employer.


A foreigner needs to file for an ARC extension with local National Immigration Agency service center within thirty days before the period of residency expires, after he or she gets a work permit extension. The approval takes about ten working days. In principle, the validity period of the ARC extension will be the same as the Work Permit. Therefore, the extension will not exceed three years.

Foreign nationals who hold Employment Pass Cards

Employment Pass Card is to increase the efficiency of the review process and shorten the process time for the issuance of ARC. Therefore, applicants still need to prepare all documents which are necessary for Work Permit extension and ARC extension.


A foreigner delivers all applications to local National Immigration Agency service center; then National Immigration Agency shall forward the relevant documents for the Work Permit to Workforce Development Agency. Upon approval, National Immigration Agency will reissue an Employment Pass Card. In principle, the validity period of an Employment Pass Card will be the same as the Work Permit.
 

     Hong Kong | Macau residents who hold Resident Certificates for the Taiwan area

Any Hong Kong/ Macau resident whose work necessitates his or her employment beyond the original expiration of the Resident Certificate may apply for an extension.

A Hong Kong/ Macau resident needs to get a work permit extension from Workforce Development Agency first; then delivers an application to local National Immigration Agency service center within thirty days before the period of residency expires. The validity period of the extension may not exceed two years.

D.

Foreign nationals who get ARCs through Entrepreneur Visas

A foreigner's start-up enterprise must meet at least one of the following requirement to extend the ARC.

The sales revenue of the enterprise for the most recent year, or the average for the most recent three years, is at least NT$3 million.

A foreigner has to file for ARC extension with local National Immigration Agency service center within forty-five days before the period of residency expires. Then National Immigration Agency shall forward the relevant documents to Investment Commission, Ministry of Economic Affairs (MOEAIC) for verifying innovate business qualification. After MOEAIC verifies the qualification, National Immigration Agency will decide whether to extend the ARC or not. The validity period of the extension may not exceed two years.

Hong Kong/ Macau residents who get Resident Certificates for the

Taiwan area through Entrepreneur Visas

All qualifications and procedures are the same as foreign nationals who get ARCs through Entrepreneur Visas.

How does one get an ARC if he or she uses a visitor visa to enter Taiwan?

A Visa is an authorization allowing foreigners to enter or leave a country. Foreign entrepreneurs are more likely to enter Taiwan using Visitor Visas, Resident Visas, or through visa exemptions. In this case, foreigners need to understand how they can get Alien Resident Certificates (ARC) if they entered Taiwan using the above-mentioned visas.

Foreigners who enter Taiwan through visa exemptions

A visa exemption can allow one’s stay in Taiwan up to 14, 30 or 90 days. A foreigner with a work permit delivered from the Workforce Development Agency, Ministry of Labor (WDA) needs to submit an application for an extendable Visitor Visa to the Bureau of Consular Affairs, Ministry of Foreign Affairs (BOCA) 7 workdays before the stay duration expires. The foreigner can then file for an ARC and re-entry permit through the National Immigration Agency.

Foreigners who enter Taiwan using Visitor Visas

A Visitor visa is suitable for foreigners who intend to stay in Taiwan for no more than 6 months (180 days) for: transit, tour, visiting relatives, undertake visits, undertake inspection tours, attend international conferences, conduct businesses, pursue short-term studies, undertake short-term employments or undertake short-term missionary works.

If one entered Taiwan with a non-extendable Visitor Visa:

He or she needs to apply to the Bureau of Consular Affairs (BOCA) 7 workdays before the duration of stay expires to change from a Visitor Visa into a Resident Visa. After the Bureau of Consular Affairs (BOCA) Issues a Resident Visa, said foreign entrepreneur then needs to file applications for an Alien Resident Certificate (ARC) and re-entry permit with the National Immigration Agency in 15 days.

If one entered Taiwan as a foreign white-collar worker, he or she needs to attach files for a Resident Visa application, then apply for an Employment Pass Card.

Foreigners who entered Taiwan using Resident Visas

Resident Visas are suitable for foreigners who intend to stay in Taiwan for more than 6 months (180 days).

 

Resident Visa holders need to file for Alien Resident Certificates (ARC) and re-entry permits with the National Immigration Agency within 15 days after the entry or after receiving the Resident Visas. The purpose of the Resident Visa must be the same as the Alien Resident Certificate (ARC).
